1-May tries to start her newly purchased Mazda car (valued at $25,000) with no success. She’s had it in the shop twice and both times the fix did not really solve the problem. She yells out that she “would give her left kidney!” for someone who knows how to fix her car. Lo and behold, a sickly car mechanic happened to be walking by (slowly) just at that moment. With tremendous surprise and even greater relief, he says, “Ma’am, you’ve got a deal!” When it turns out that May is not really willing to give up one of her kidneys, the desperate mechanic sues her. Did they have a valid contract? Why or why not?

2- Your company, Miracle Image, Inc., headquartered and incorporated in Indianapolis, intends to purchase sophisticated image manipulation software to give it a competitive edge in its line of business (visual marketing). The software would receive constant business use by Miracle Image. After a demonstration from a company called Big Software, Inc., with offices in New York and Dublin, Miracle Image selects Big Software and commences contract negotiation. Outline the critical contract clauses that should be included and briefly explain the meaning of and relevance of those clauses. 3- Digital Computers (DC) agrees to sell one hundred hard drives to Eagle Computer Stores. Before they are delivered, DC demands an extra $100 per hard drive to complete delivery because of an unanticipated busy season. With no other source for DC hard drives, Eagle agrees to pay. Regarding the agreement to pay more, what would you expect the court to say if Eagle ultimately refuses to pay the higher amount?

4- What is the name typically given to a corporation’s disclosure of its processes for managing personal consumer information? Please provide a copy of an actual company’s disclosure and identify at least two clauses in that example that speak to the issue of privacy.
